Terms of Use for Adult ADHD Starter Kit

The use of the Adult ADHD Starter Kit ("Kit") provided by Unlocking ADHD Limited ("UAL") shall be your agreement to abide by each of the terms set forth below.

Please read the Terms of Use ("these Terms") carefully before using the Kit. If you do not agree with any of these terms, please do not use the Kit:

1. General Use Restrictions

1.1 UAL or third parties granting rights to UAL hold all right, title, and interest in and to the materials in the Kit, which are the copyrighted work of UAL or such third parties. UAL grants you a limited, personal, non-exclusive and non-transferable license to use only for purposes described in the Kit. Except as stated herein, you have no right to copy, download, display, perform, reproduce, distribute, modify, edit, alter or enhance any of the materials in the Kit in any manner. This limited license terminates automatically, without notice to you, if you breach any of these Terms. Upon termination, you must immediately destroy any downloaded and printed materials. You have no right, title or interest (and no copyright, trademark or other intellectual property right) in or to any part of the Kit and you agree not to use any part of the Kit in any manner that is inconsistent with the purposes described in the Kit.

1.2 It is your responsibility to ensure that the jurisdiction you are resident in or from which you access the Kit permits you to access and use the Kit. By accessing and downloading the Kit, you represent and warrant to UAL that the jurisdiction you are resident in or from which you access the Kit permits you to access and/or use the Kit.

1.3 You also agree that your use of the Kit is strictly for the limited purposes described in the Kit and is not intended to be a substitute for obtaining the services of an appropriate qualified person who can assist you with your condition.

2. Intellectual Property

2.1 The entire content of the Kit, such as text, pictures, graphics, sound, animations and videos, including corporate logos and brands, is protected by trademark, design and copyright law and other laws for the protection of intellectual property. Distributing, amending or copying the contents of any part of the Kit is prohibited.

2.3 Users of the Kit may not reproduce, hyperlink, retransmit, disseminate, sell, distribute, publish, broadcast, circulate or commercially exploit the information found on the Kit in any manner without the express written consent of the UAL.

2.4 Unauthorized or unlawful use of any materials contained in the Kit may violate intellectual property laws, the laws of privacy and other applicable laws and regulations and tantamount to a breach of the provisions of these Terms. You alone are responsible for your actions or the actions of any person using your user name and/or password. As such, you shall indemnify and hold UAL and its officers, directors, employees, affiliates, agents, licensors, and business partners harmless from and against any and all costs, damages, liabilities, and expenses (including attorneys’ fees) incurred in relation to, arising from, or for the purpose of avoiding, any claim or demand from a third party that your use of the website or the use of the website by any person using your user name and/or password  violates any applicable law or regulation, or the rights of any third party.

2.5 UAL will not be liable, whether under tort or contract, for any damages, losses or expenses suffered or incurred by visitors, including direct, consequential, incidental, special or indirect damages or loss of profits or trading losses, arising from or otherwise resulting directly or indirectly from your use of the Kit even though UAL has been advised or is aware of the possibility of such damages, losses or expenses.

3. Limitation of Liability

3.1 Your use of the Kit is at your own risk and on an “AS IS” and “WHERE-IS” basis, without any warranty of any kind, either express or implied, to the fullest extent permissible and subject and pursuant to the applicable law.  UAL, for itself and any third party providing materials, services, or content to this website, make no representations or warranties in connection with the Kit including but not limited to the quality, suitability, truth, accuracy or completeness of any material, information, product or service contained on the website. All conditions, representations and warranties, whether express, implied or statutory regarding suitability for a particular purpose, or non-infringement of third party rights, are hereby disclaimed. UAL will not be liable to you or any third party for any damages of any kind, including but not limited to, direct, indirect, incidental, consequential or punitive damages, arising from or connected with the Kit, including but not limited to, your use of the Kit or your inability to use the Kit.

3.2 UAL cannot guarantee that the Kit is free from errors. The Kit may include inaccuracies or errors that may affect the quality of the materials in the Kit. The materials in the Kit may not have been independently verified or authenticated in whole or in part by UAL. UAL does not warrant the accuracy or timeliness of the materials in the Kit. UAL therefore accepts no liability and furnishes no guarantee; neither expresses nor implied that the information in the Kit is up-to-date, accurate or complete and free from errors or omissions.

4. Applicable Law

These Terms and all questions and disputes relating to the use of the Kit are subject to the laws of Singapore exclusively. You agree to submit to the jurisdiction of the courts located in Singapore, for the resolution of all disputes arising from or related to these Terms and/or your use of the Kit.
